Challenge to Sengar's Bail: SC Sees Appeal Over HC Ruling

In a move to protect the rights of the Unnao rape survivor and the integrity of the justice system, two lawyers have filed a plea in the Supreme Court challenging the Delhi High Court's order granting bail to accused Kuldeep Sengar in the 2017 Unnao rape case. The plea, filed by Anjale Patel and Pooja Shilpkar, argues that the high court ignored crucial evidence of the accused's brutal crimes, misuse of influence, and intimidation tactics. According to the petition, Sengar orchestrated the murder of the survivor's father while in judicial custody, aiming to silence the family and undermine justice. The lawyers point out that the Supreme Court had previously transferred the trial to Delhi's Tis Hazari Court to ensure a fair trial and protect the survivor and witnesses. However, the high court's bail order disregarded this decision, potentially compromising the integrity of the trial. The plea also highlights the HC's contravention of settled law, which emphasizes caution when granting bail in rape and murder cases. The Unnao rape survivor, who staged a protest at India Gate after Sengar's bail, expressed her deep distress and fear, stating that she feels extremely unsafe with the accused's release. While Sengar will remain in jail due to his 10-year term for the custodial death of the survivor's father, the Supreme Court's review of the bail order is crucial in upholding justice and protecting the rights of the survivor and society. The CBI has also decided to file an appeal against the high court's ruling, further underscoring the need for the Supreme Court's intervention in this case.
