The Delhi high court has overturned a 2002 conviction of two city government engineers, citing insufficient evidence to prove their guilt beyond a reasonable doubt.
Justice Chandrashekharan Sudha set aside the 2002 verdict, which had sentenced the engineers to two years in prison for accepting a bribe of ₹1,800 in 1991.
The court held that the trial court had relied on 'unsatisfactory evidence' to convict the engineers, and that crucial witnesses, including the contractor, were not examined during the trial.
The court also noted inconsistencies in the evidence presented by the agency and that there were no subsisting dues or liability on the part of the department towards the contractor at the relevant time.
The two engineers, VK Datta and Dinesh Garg, were represented by advocate Sameer Chandra and senior advocate Sunil Dalal, while the Central Bureau of Investigation (CBI) was represented by special public prosecutor Atul Guleria.
