Trans rights activists in India have urged the government to withdraw the proposed Transgender Persons (Protection of Rights) Amendment Bill, 2026 in its entirety, citing concerns that the amendments could harm the rights, dignity, and identity of transgender communities.
The activists argue that the proposed amendments would push transgender persons back into a system where they would have no rights, leading to lack of opportunities, restricted healthcare access, violence, and trauma.
They also expressed concern that the amendment removes the right to self-determination, which was recognised in the NALSA judgment and rooted in constitutional guarantees of equality and non-discrimination.
The activists further alleged that the amendment introduces medical gatekeeping, requiring transgender persons to undergo surgery, appear before a medical board, and then approach the district magistrate, making it extremely difficult for them to access recognition and benefits.
The community has demanded the withdrawal of the Bill in its entirety, urging lawmakers to include them in the conversation before making laws that affect their lives.
