The Rajasthan high court has ordered the deletion of critical remarks on the recent amendments to the transgender rights act from a previous verdict.
A division bench of justices Arun Monga and Yogendra Kumar Purohit noted that the text was included by mistake and was neither intended nor necessary.
The court had raised concerns over the law, observing that it removes the statutory recognition of a transgender person's right to self-perceived gender identity.
The comments, which also asked the Rajasthan government to prioritise self-identification of gender in its policies, were made while deciding a petition filed by a transgender person.
The bench, however, rejected the request to exclude the epilogue from precedential purposes and directed a new clarification to be inserted.
The court clarified that the epilogue will now record that the judgment was being finalised when Parliament passed the Transgender Persons (Protection of Rights) Amendment Bill, 2026.
