A parliamentary committee has expressed surprise over the National Medical Commission's decision to issue crucial regulations without obtaining clearance from the Union law ministry.
The Lok Sabha Committee on Subordinate Legislation found that the regulations, which were published under the Ministry of Health and Family Welfare, were not vetted by the law ministry from a legal, constitutional, and drafting point of view.
The committee report, which was tabled in the recently concluded Budget session of Parliament, noted that getting draft rules and regulations vetted by the law ministry is an essential prerequisite to prevent future infirmities.
The parliamentary panel recommended that the health ministry be more vigilant in ensuring that all drafted subordinate legislations are duly vetted by the law ministry before they are published in the Gazette of India.
