New Delhi, The Supreme Court on Thursday refused to entertain a plea filed by the grand nephew of Netaji Subhas Chandra Bose, seeking directions to bring back to India the ashes believed to be those of Bose from Tokyo's Renkoji temple.
Senior advocate Abhishek Singhvi, appearing for petitioner Ashis Ray, sought permission to withdraw the petition after the bench showed its disinclination to entertain the plea.
The bench, comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and Vipul M Pancholi, permitted him to withdraw the petition.
The CJI asked how many times this issue would come up before the apex court, noting that last year itself, the top court had dismissed one petition.
The bench said Bose was one of the greatest leaders of our nation, and we all bow down to his sacrifice.
However, the bench observed that until and unless Bose had died, there couldn't be ashes.
The bench asked Singhvi how many family members were supporting the plea, and he said Bose has only one heir, his 84-year-old daughter, and the petitioner is her grand nephew.
The bench said if the heir wanted the ashes to be brought to the country, she must come before it.
