Delhi HC Delays Take Down of Defamatory Content Against J&K Dy CM, Demands Identity of Uploaders

The Delhi High Court has refused to order the immediate removal of allegedly defamatory material posted online about Jammu and Kashmir Deputy Chief Minister Surinder Kumar Choudhary. Meta's counsel objected to the order, arguing that Choudhary was only targeting the platform without implicating the individuals responsible for the content. The court has directed Meta to provide the details of the uploaders to Choudhary within three days and asked him to serve the individuals with a copy of the suit. Choudhary's lawyer had sought an immediate take-down of the content, citing damage to his reputation. However, the court clarified that it would pass orders if the individuals do not appear despite being served. The court's decision comes after Choudhary's application to preponement the hearing date, citing 'colossal damage' to his reputation. The matter is scheduled to be heard on December 16. The high court had previously fixed January 13 as the next date of hearing, but Choudhary's application has led to a delay in the proceedings.
