The Supreme Court has ruled that employees are responsible for keeping their employers informed of their whereabouts, not the other way around.
A recent judgment stated that an employee cannot claim that a notice was sent to an old address if they failed to update their employer with their new address.
The ruling came in a dispute between an employee and his employer, Rifilis Engineering Pvt Ltd, over the employee's unauthorized absence from work.
The employee, Arjun Gupta, claimed that he had gone on leave to care for his ailing mother, but the Supreme Court found that he had produced no evidence to support this claim.
The court also noted that Gupta had failed to send any written communication to his employer during his absence and had produced no evidence of attempting to rejoin duty.
The Supreme Court overturned the orders passed by the labour court and the Allahabad High Court, ruling that the employee had absented himself without authorization and was not entitled to reinstatement or back wages.
