The Supreme Court has expressed its disappointment with the Madhya Pradesh High Court for rejecting a bail plea without providing reasons, in a case involving a man convicted of counterfeiting currency. In a recent judgment, the apex court set aside the high court's order, stating that it failed to follow established principles of law and did not provide any justification for the decision.The case involves Sukhchain, who was convicted by a sessions court in Jabalpur for counterfeiting currency and sentenced to seven years in prison. His appeal was admitted by the high court, but his plea for suspension of sentence and release on bail was rejected without explanation.The Supreme Court, in a bench led by justices JB Pardiwala and KV Viswanathan, noted that the high court's order was a 'non-speaking order', which does not provide any insight into the court's reasoning. The bench emphasized that appellate courts must apply a liberal approach when considering suspension of sentence, especially in cases involving fixed-term sentences. In this case, the top court held that the high court failed to apply the settled principles of law and did not consider the appellant's grounds for questioning the prosecution case.The Supreme Court has directed the release of Sukhchain on bail, subject to the conditions set by the trial court. The court's decision underscores the importance of transparency and accountability in the judicial process.
