Uttarakhand HC Makes Cheque Bounce Complaints Easier: Email and WhatsApp Summons Now Allowed

In a bid to declutter India's courts and reduce the burden on the judicial system, the Uttarakhand High Court has introduced a revolutionary change in the process of filing cheque bounce complaints. As per a recent circular, summons in cheque bounce cases can now be issued through email and WhatsApp, in addition to traditional modes. The circular, issued by Registrar General Yogesh Kumar Gupta, states that complainants will be required to provide the accused individual's email and WhatsApp details, along with an affidavit certifying the authenticity of the information. A synopsis in a prescribed format must be attached to every complaint, which will be entered into the computer system by the court staff. The court has also introduced an online payment facility, allowing the accused to directly deposit the cheque amount by entering the CNR number or case credentials. If the accused makes payment through this facility, the court may close the case based on compounding. This move has been made in compliance with a recent Supreme Court judgment, which observed that lakhs of cheque bounce cases are pending across the country, placing a heavy burden on the judicial system. However, the high court has also cautioned that false email or WhatsApp information may lead to penal action. The introduction of email and WhatsApp summons is expected to make the process of filing cheque bounce complaints more efficient and reduce the time taken to resolve cases. The court has also made available a draft template that will automatically calculate the limitation period relating to the 'cause of action,' making it easier for complainants to navigate the process.
