In a rare opportunity for Indian professionals stuck in long backlogs, the US has expanded the pathway for employment-based Green Card applicants. The US Citizenship and Immigration Services (USCIS) has issued two crucial notifications: a filing flexibility update and a substantially expedited January 2026 visa bulletin.
The January 2026 visa bulletin shows significant gains in various employment-based categories, with Indian applicants' EB-1 and EB-5 visas experiencing the most notable improvements. This update builds on the progress made in the December 2025 bulletin.
Immigration attorneys are warning that this combination has created a unique opportunity for filing. Professionals whose priority dates are not yet current can now apply under either the Final Action Dates chart or the Dates for Filing chart. However, experts caution that such opportunities are often fleeting.
The January bulletin reflects advancements across nearly all employment-based categories, with EB-1 progressing by almost a year and EB-5 advancing by nearly two years for Indian applicants. EB-2 and EB-3 categories have also experienced forward movement, bringing relief to applicants from countries with significant backlogs, such as India and China.
Michael Valverde, an Immigration Policy/Procedure Expert, attributes the extent of progress to USCIS's potential efforts to increase applications due to concerns about unused visas. He notes that extended processing times and increased denial rates have impacted overall visa utilization.
With the filing period from January 1 to January 31, applicants must be prepared with necessary documentation, including medical examinations, which USCIS now requires to be submitted with the I-485 application.
